It is highly recommended that after receiving an office action, one can just simply run IP Author to take the advantage of all features provided by the tool to effectively save one’s time in handling the OA. There are a couple of options that one could consider on how to proceed. NOTE: these options are not exclusive to each other, but rather, one could adapt and take whatever it makes sense in each of the steps.
1. First option is to just simply run through the whole process on “auto” mode with all default options. It takes less than a half hour to complete. Then, the next step is to review the output. One may focus on “suggested amendments” and “suggested arrangements”. This would likely give you with some good answers on how to strategize your response already. It is now up to you either to use the output template or your own template for the 1st draft.
2. The second option is to follow IP Author step by step: by trying to understand examiner’s reasoning and cited references given by IP Author;
a. If you agree, proceed with the next step.
b. If you believe what is provided is not adequate, you could enhance the arguments by 1) provide IP Author with more texts from patent specification; 2) manually modify some key points
Regardless of which option or the mix of options you choose, IP Author would likely be able to provide you with good information that you would need when working on the OA. Each of the steps discussed above contains good information/reference on how you can proceed with your response, thus, to save you time with this otherwise tedious “routine” work.
